Kerala HC increases the compensation of the young traffic accident victim to 53 Lakh

The Supreme Court of Kerala increased the compensation of a young traffic accident that was completely disabled after a weakening accident from LA 11 LAKH to La 53 Lakh.

Sumisha, a 26 -year -old Thrissur, was only seven years old when he met an accident in 2006 and lived in an orphanage since then. While his sister lived with her husband, she lost her father in 2009 and in 2020. The court stated these conditions among the reasons for reviewing the previous La 11 award given by the Motor Accident Court (MACT), Thrissur.

His advisor said he was completely bedridden and could not move out of bed, because the four limbs were not functional because of the effect of the accident. In his report, the Regional Legal Services Authority Thrissur pointed out that he could not move on his own and should be removed from his room in a wheelchair. His sister and orphan staff announced that their health is in a critical state.

A class 1 student, during the accident, due to injuries in the accident could not continue to work. Like others, he did not enjoy the life of a child, adolescent or youth. He would also miss childhood entertainment, the excitement of youth and the pleasures of marriage life and could not have children. He could not enjoy the beauty of nature. The Court said that he could not walk even in the room where he was limited, and decided by Sumisha for a petition who wanted to improve the quantum of compensation.
